The U.S Supreme Court & the Culture War

[January 11, 2026]  Scheduled for this coming Tuesday, the U.S. Supreme Court is poised to hear oral arguments in one of the most contentious culture-war battles of our time: the inclusion of trans men in women’s sports.  The question before them is whether states can protect women’s rights based on sex.  But this is much more than a legal battle. It’s a battle between Woke ideology and American exceptionalism.

In an article by Jennifer Sey on the NY Post Opinion pages, she believes the Court’s decision is a “once-in-a-lifetime decision point for women.” It should be common sense that “gender” does not trump biological sex. If gender becomes part of the definition of women’s sex, Title IX, which prohibits sex-based discrimination, would have to be amended to include biological men who “identify” as women. Or, to put it another way, gender would override sex as a precondition for discrimination.

The technicalities are important to lawyers and justices, but to us ordinary folks, this is about a pernicious, neo-Marxian ideology undermining a tradition that has existed since the Title IX Amendment was passed in 1972. The arguments for the original Title IX were intended to allow women to compete against women, which is clearly a fairness issue.

The point here is not to rehash the ongoing cultural battle but to highlight that political leaders must stand against unfair discrimination. They must also obey the law and expose any government program or law that is unethical, immoral, or incompatible with America’s core values.

Let us hope the Court doesn’t kick the can down the road by ruling on a technicality to avoid being dragged into the culture war. They are, by definition, part of it, and a cowardly way out like this would fail on its face.

The Court must not set women’s sports back. It should outright reject trans men in women’s sports (and not change Title IX), using clear and unambiguous language. Anything else is a capitulation to the dying fad of transgenerism.

    🚨 HOLY SMOKES. SCOTUS Justice Sam Alito asks ACLU lawyer “what is a man and a woman?” and they DON’T HAVE A DEFINITION.

    Alito’s response is perfect.

    ALITO: What does it mean to be a man or woman?

    ACLU: We do not have a definition for the Court.

    ALITO: How can a court determine whether there’s discrimination on the basis of s*x, without KNOWING what s*x means?!

    The culture war, as many call it, is being won by the normal people of the West. It is a hard struggle against many of the long-ago, proven terrible governing ways. Socialism, Communism, Nazism, fascism of all types, and theocracies, are all losers that use their citizens as soldiers to be destroyed so that the elites can have an easy life and be respected. Ultimately, it destroys everything. We fought against Communism, for example, in Vietnam. And the North Vietnamese communists won out. But the country eventually figured out that strict communism is a total failure, so they are communists in name only. That is why they evertually adopted capitalism and they are an up and coming country that does not try to spread the communist ideology. Why? Because it doesn’t work, and they know it. Let’s see how the culture war eventually works out but I can’t see how the radical Leftists will win out over those who use ancient and repeatedly proven ways to live well.

    The Culture War has turned into a Rebellion by radical, left wing Democrats who have adopted the strategy of protecting illegal aliens, criminals, and terrorists. What could go wrong? Well, for anybody with common sense, this should be obvious. If you don’t like these people being apprehended/arrested and go to jail, then advocate for changes in our laws. Don’t attack our LEOs and ICE men and women who are, factually, making our country safer. Oh, the laws are not going to change.

    Good article by Jennifer Sey. She was caught up in this trap and she is now writing about it. Good for her. Like several others here, I am hoping that the SCOTUS doesn’t screw this up with some pansy decision that sits on the fence or tracks a middle road. This whole idea of transgenderism is an example of stupidity gone wild, and who is supporting it? You guessed it. It’s the Democrat Party … what is wrong with these poeople? They must be looking for something dumb to support, and then they all jump on the bandwagon. Did they ever think this through about how horrible the impact of them pushing the trans agenda has become?

      Here’s another question. Why do leftists/democrats always support these wild, outside our value system ideas. Why do they support what is clearly a nutty idea? Are they just overly compassionate? Gen. Satterfield, a couple of days ago, attempted to answer that question in his article titled “An Overproduction of Comfortable Do-Gooders.” https://www.theleadermaker.com/an-overproduction-of-comfortable-do-gooders/ I recommend reading this, as it helps understand this trend in leftists.

    Mental illness should not be given a prominent place our society. Using “gender” in place of sex, especially “self-identified” sex, must be treated as it is; an illness that’s pernicious.

    Will SCOTUS cop out? Will they take the easy road with a narrow, technical ruling? Will they play the coward? Chief Justice Robert’s has done it before. I’m on the wait and see side of the equation. But this should be a clean, unambiguous decision. That is how we solve problems, not with fence sitting.

      Good point, but I don’t have the same level of confidence you have in the Supreme Court . They regularly f-up decisions that have detrimental consequences because they are weak minded, SCARED (a better descriptor). Weakness invites in the devil. Strength of will solves problems. And this Court is, thank God, a conservative court. Be strong everyone. DOn’t allow your emotions to run you. Be professional. Be good, and don’t be a fool. Read Gen. Satterfield’s “55 Rules for a Good Life” and you will see that there is a way forward. RULE “Cowards die a thousand times.”

        Got that right, Susie Q. I have very little confidence in the Supreme Court. Their recent decisions have been a bit weird.
