[August 28, 2025] I hate to see the American Flag burned. Disrespect to Old Glory is openly dishonoring those who came before us and those that sacrificed their lives for the flag. And it matters not that the flag burners are sufficiently aware of their disrespect or not. Cluelessness is no excuse.
This past Monday, August 25th, President Trump signed an Executive Order on American Flag burning. As expected, this has re-ignited a very old debate whether flag burning is aligned with the First Amendment free speech clause. Many have condemned Trump’s EO as unconstitutional but they have not read it, as we all should.
The U.S. Supreme Court ruled that flag burning is a form of constitutionally protected symbolic speech. However, not all potential legal issues were resolved in the 1989 SCOTUS decision and therein lies a wedge that President Trump is exploiting.
The Executive Order states:
“Notwithstanding the Supreme Court’s rulings on First Amendment protections, the Court has never held that American Flag desecration conducted in a manner that is likely to incite imminent lawless action or that is an action amounting to “fighting words” is constitutionally protected. See Texas v. Johnson, 491 U.S. 397, 408-10 (1989).”
The order addresses actions that violate “content-neutral laws, while causing harm unrelated to expression, consistent with the First Amendment.”
“(a) The Attorney General shall prioritize the enforcement to the fullest extent possible of our Nation’s criminal and civil laws against acts of American Flag desecration that violate applicable, content-neutral laws, while causing harm unrelated to expression, consistent with the First Amendment. This may include, but is not limited to, violent crimes; hate crimes, illegal discrimination against American citizens, or other violations of Americans’ civil rights; and crimes against property and the peace, as well as conspiracies and attempts to violate, and aiding and abetting others to violate, such laws.”
The EO directs the U.S. Attorney General to “vigorously prosecute those who violate our laws in ways that involve desecrating the American Flag…” Furthermore, the EO has an immigration angle. It says that “foreign nationals that have engaged in American Flag-desecration activity” shall “deny, prohibit, terminate, or revoke visas, residence permits, naturalization proceedings, and other immigration benefits, or seek removal from the United States.”
There will certainly be vigorous legal challenges to this EO. We know that political Leftists revel in American Flag burning because they hate America and the Flag. I doubt these Leftists will articulate their hatred because most Americans disagree with them on nearly every social, economic, and political issue today.
I fly the American Flag at my home every day of the year. And I wore it on my uniform for nearly four decades. Standing up for the American Flag is common sense.
